1988. Yes, 1988. 1988. Only 34 years ago. It was only in 1988 that Canada’s Supreme Court struck down the then abortion law and according to Morgantaler Decision, “left it to Parliament to come up with a new abortion law that would balance the rights of women with the state’s interest in the protection of the fetus, without offending the Charter.”

It was with this decision by the Court that abortion became healthcare for women and pregnant people in Canada. It is also how it makes it not a constitutionally protected right. With the recent decision by the United States Supreme Court to turn back the clock and take back what about 6/10 Americans believe should be a legal practice, we must also be on guard for yet more attempts here at home. 

All Canadians, not just women, not just pregnant people, not just our allies, need to be talking about abortion as healthcare in Canada in the event that a political party decides to do what the United States Supreme Court did. The difference being that this decision will stand in the United States until the makeup of the Court changes or if President Biden was to add more members to the court whereas in Canada, this will be a political decision made by people we elect. That is a huge and incredibly important difference.
